✨ No LMIA points, No Flag pole ✨

 




This is the latest immigration news. It was revealed yesterday in a surprise TV press conference. There are several key points, but two stand out in particular.

First, there was an announcement to eliminate the 50 or 200 points currently awarded under the Express Entry (EE) CRS system for PR support through LMIA. However, Immigration, Refugees and Citizenship Canada (IRCC) has not yet officially updated or announced this change, so we don’t know when or how it will be implemented.

There are various possibilities. The CRS points for what is commonly referred to as “LMIA points” are part of the Arranged Employment category, which is broken down into several cases:

1 When a job offer is received through an LMIA.

2 When someone is working under an LMIA-based work permit.

3 When someone is exempt from an LMIA but has been working for more than a year on a closed work permit.

It is unclear whether the removal of points applies to all three cases, just the first case, or the first and second cases. We will need to wait for an update from IRCC to clarify this.

Second, the announcement included the elimination of “flagpoling.”
Flagpoling refers to the process where someone drives to the U.S. border, undergoes entry processing into the U.S. but immediately returns to the Canadian border to apply for a work permit or study permit. This is often called "flagpoling" because it involves just turning around at the U.S. border without fully entering the country.

This also leaves room for various interpretations.
For example, if someone living in the U.S. receives a job offer in Canada and decides to enter Canada via a land border, this process does not legally constitute flagpoling. However, if immigration procedures are no longer conducted at the border, will such individuals be forced to fly into Canada and apply at an airport?

Similarly, for individuals who have spent three or four days traveling in the U.S. and then return to Canada to process their application, the question remains whether this would also be affected.

As for GS, one of our clients visited the border today. While they were not immediately interviewed, they were able to schedule an appointment to return next week. This suggests that, despite yesterday’s announcement, border work permit applications are still being processed as of now.

eCOPR (EE - CEC)

 




A client pursuing Express Entry (EE) has officially become a permanent resident! 👀

Immigration Category: EE - CEC
Position: Food Service Supervisor (NOC 62020)

EE Registration: October 4, 2023 (CRS Score 529)
EE ITA Received: April 23, 2024 (Cut-off Score 529)
PR Application Submitted: May 16, 2024
PR Portal Letter Received: October 9, 2024
eCOPR Letter Received: December 12, 2024 (7 months after application submission)

Two Notable Points

  1. CRS Score
    Initially, when registering on October 4, 2023, the client’s CRS score was 493. However, the score was improved and updated in April 2024. Despite this, the first draw after the update on April 10 had a cut-off score of 549, so it wasn’t successful. However, the first general EE draw that followed had a cut-off score of 529, which matched the client’s updated registration score.

When the registration score matches the cut-off score, not everyone necessarily receives an ITA. In such cases, preference is given to candidates who registered earlier. Since our client registered on October 4, 2023, she was able to receive an ITA and celebrate this milestone.

  1. Timeline from PR Portal Letter to eCOPR
    Typically, the time between receiving the PR portal letter and the final eCOPR letter can range from as short as 2-3 days to as long as 8-9 months. For this client, it took two months to receive the final eCOPR and officially become a permanent resident.

Two Key Takeaways

  1. It’s advantageous to register for EE as soon as you’re eligible, even if your CRS score isn’t high at the time.
  2. After receiving the PR portal letter, many assume the process is nearly complete, and the eCOPR will arrive shortly. However, this stage can take longer than expected, so patience is crucial.

In this case, the client received her PR portal letter five months after submitting their application, marking the completion of the review process. She then waited an additional two months to receive the final eCOPR and officially become a permanent resident.

Work Permit Result Update.

 




Good news! Work Permit Case Approved 👀

The processing time for both LMIA and the work permit has been quite lengthy.

There were no delays due to incomplete documentation or additional document requests. Every time we inquired about the status, we only received the frustrating response that it was "in progress," but now the approval has finally come through.

One notable aspect of this client’s case was that he was not a citizen of a visa-exempt country with eTA access to Canada. Instead, he was residing in Canada on a visitor visa. At the time of application in July, it was possible to apply for a work permit from within Canada while on a visitor visa, so we submitted the application online.

The news is even more exciting and dramatic because the approval came just one week before the expiration of the client's current visitor visa.

AOS approval

 



A client proceeding with their AAIP application under the AOS stream has received provincial approval. 👀

AAIP Application Submission: February 6, 2024 (AOS)
AAIP Approval: December 3, 2024 (Processing time: 10 months)

 

Recently, the federal processing time following provincial approval has been significantly reduced to under one year.

 

This case was submitted before the AAIP transitioned to the EOI (Expression of Interest) system. As seen here, the AAIP processing time for this case took longer. Alberta prioritizes positions and regions it deems urgent, while regions or positions evaluated as less critical are often processed later.

 

Now that the system has transitioned to EOI, the AAIP selects candidates by distributing immigration streams, regions, and positions based on current needs.

 

Although this case took a while, we extend our heartfelt congratulations to the client on receiving AAIP approval. The next step is to submit the final immigration documents to the federal government.
