In the past
two to three months, significant news regarding Canadian immigration has been
surfacing almost daily. Unfortunately, most of this news has been filled with
discouraging updates rather than hopeful ones.
Since November
20, the Canadian immigration community has been abuzz with discussions
following comments made by Immigration Minister Marc Miller during an interview
with The Toronto Star.

Fraud in
Immigration is a Serious Problem
Fraudulent
job offers, in particular, have become a significant issue in the immigration
market.
Potential
Changes to the CRS in Express Entry
One of the
solutions suggested by the Immigration Minister Marc Miller includes removing
the additional points granted for LMIAs in the CRS.
Illegal
Activities Must Be Rooted Out from the Start
Systems must
be put in place to eliminate any actions encouraging people to engage in
illegal activities to obtain permanent residency, starting from their initial
immigration process.
What
Could This Change Mean, and How Might It Unfold?
Changes
in the CRS Scoring System
Currently,
candidates can receive an additional 50 or 200 CRS points in Express Entry (EE)
through LMIA-based job offers. This does not mean that LMIA itself grants
additional points but refers to the extra points awarded for AEO (Arranged
Employment Offer). If a candidate receives a job offer through a closed work
permit (not an open work permit) that specifies their employer, they gain
additional CRS points.
If
additional points for LMIA-based job offers are eliminated while other AEO
points remain unchanged, fairness issues could arise. Thus, removing LMIA
points likely means eliminating AEO points altogether.
This change
will also affect programs like the Young Professional Work Permit, which is
increasingly popular among young Koreans, as well as the Intra-Company Transfer
(ICT) Work Permit.
Impact of
AEO on Recent CRS Scores
From 2021 to
2023, 16% of candidates who received an Invitation to Apply (ITA) for permanent
residency benefited from additional points through AEO. For those whose points
were validated, this figure increased to 18-21%. This demonstrates the
significant advantage of LMIA-based job offers in securing an ITA.
If this
scoring system is abolished, CRS cut-off scores could decrease, making it
easier for candidates without AEO points to qualify.
How
Serious is LMIA Fraud?
Why is the
Immigration Minister considering such drastic measures? According to IRCC, the
cost of obtaining an LMIA-based job offer for AEO points ranges from CAD 15,000
to CAD 75,000.
This issue
is particularly prevalent among candidates from countries in South Asia,
including India, where such practices are widespread.
Why Has
AEO Become So Important?
In 2024, the
lowest CRS score for Canadian Experience Class (CEC) candidates was 509 points.
This is a sharp increase compared to the 431-point minimum score in 2020. As
CRS scores rise, many candidates have turned to AEO points to improve their
scores. With LMIAs offering 50 to 200 points, they present an accessible way to
boost CRS rankings.
For Those
Aiming for Canadian Immigration
Understanding
the Direction of Immigration Policies
It is
essential not to fixate solely on the removal of AEO points in the CRS but to
consider the broader direction of Canadian immigration policies. Prepare
according to the overarching trends and goals of the immigration system.
Securing
and Maintaining Temporary Resident (TR) Status
The Canadian
government has consistently emphasized facilitating the transition from
Temporary Residents (TR) to Permanent Residents (PR). However, TR refers to
individuals with valid permits such as study or work permits, not mere
visitors.
Study
Permits as an Alternative
Although
obtaining study permits is becoming more challenging, enrolling in a program
aligned with Canada’s industrial goals at a Designated Learning Institution
(DLI) remains a strong option. DLIs include both public and private
institutions recognized by the government.
Improving
Language Proficiency
Language
skills, particularly in English and French, remain critical. Higher language
test scores can significantly improve CRS rankings, with French being
especially valued in Canada’s immigration system. Candidates with strong skills
in both languages have a distinct advantage.
